By accessing or using PicDeck (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

PicDeck is a local-first image processing application that provides tools including but not limited to: background removal, smart cropping, object segmentation,瑕疵修复 (inpainting), vectorization, and an infinite canvas for image organization. All processing occurs locally in your browser using WebAssembly and AI models.

3. License

3.1 Free Tier

PicDeck offers a free tier with basic features. You may use the free tier for personal and commercial purposes subject to the limitations described in the Service.

3.2 Pro License

Upon purchasing a Pro license, you are granted a non-exclusive, non-transferable license to use all Pro features. The Pro license:

  • Is a one-time purchase (not a subscription) unless otherwise stated
  • Includes personal and commercial use rights
  • Is valid for up to 2 devices simultaneously
  • Includes free updates to the Service

3.3 Restrictions

You may not:

  • Redistribute, resell, or sublicense the Service
  • Reverse engineer, decompile, or disassemble the Service
  • Use the Service to build a competing product
  • Remove or alter any proprietary notices

4. User Accounts

You may be required to create an account or sign in to access certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

5. Payment and Refunds

  • Payment: All payments are processed through our third-party payment provider (Creem). Prices are in USD unless otherwise stated.
  • Refund Policy: We offer a 7-day money-back guarantee from the date of purchase. Contact us at support@getpicdeck.com to request a refund.
  • Price Changes: We reserve the right to change pricing at any time. Existing purchases are not affected by price changes.

6. User Content

You retain all rights to the images and content you process using PicDeck. Since all processing occurs locally on your device, we do not access, store, or claim any rights to your content.

7. Acceptable Use

You agree not to use the Service to:

  • Process illegal or infringing content
  • Violate any applicable laws or regulations
  • Interfere with or disrupt the Service
  • Attempt to gain unauthorized access to the Service

8. Intellectual Property

The Service, including its software, AI models, design, and branding, is owned by PicDeck and protected by intellectual property laws. You are granted a limited license to use the Service as described herein; no other rights are granted.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, PICDECK SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your license to use the Service will end, but refund eligibility will be determined on a case-by-case basis.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which PicDeck operates, without regard to conflict of law principles.

13. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated by posting the updated Terms on this page. Your continued use of the Service after such modifications constitutes acceptance of the updated Terms.
